1. Acceptance of Terms

By accessing or using the Indussi website (indussi.com), submitting a contact or quote form, communicating with us via phone, email, or SMS, or engaging our professional services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy, which is incorporated herein by reference.

These Terms apply to all visitors, clients, prospects, and any other parties who interact with Indussi through any medium, including our website and direct business communications.

2. Company Information

These Terms of Use govern your interaction with:

Indussi is a member of the Concrete Reinforcing Steel Institute (CRSI) and the American Concrete Institute (ACI). Our services are directed at B2B clients in the United States construction industry.

3. Description of Services

Indussi provides professional structural engineering drafting and detailing services, including:

  • Rebar Detailing — production of rebar shop drawings, bending schedules, and placement drawings compliant with ACI 318 and applicable codes
  • Structural Steel Detailing — connection design, steel shop drawings, and BIM modeling services
  • Estimation — quantity takeoffs and rebar estimation services
  • Tilt-Up Panel Drawings — panel layout and detail drawings for tilt-up concrete construction
  • Solar Panel Roofing Systems — structural drawings for rooftop solar installations

All services are subject to separate written service agreements or statements of work. These Terms govern general use of our website and preliminary business communications only, not the specific terms of individual project engagements.

4. Website Use & Conduct

4.1 Permitted Use

You may use our website for lawful purposes related to evaluating or engaging Indussi’s professional services. You agree to use the site in a manner consistent with applicable laws and regulations.

4.2 Prohibited Conduct

You agree not to:

  • Use the website for any fraudulent, unlawful, or harmful purpose
  • Attempt to gain unauthorized access to any part of the website or our systems
  • Use automated tools, bots, or scrapers to extract data without our written consent
  • Transmit viruses, malware, or other harmful code
  • Impersonate Indussi, its employees, or any other party

Interfere with the proper operation of the website

4.3 Accuracy of Information

While we strive to ensure all information on our website is accurate and up to date, Indussi makes no warranties regarding the completeness, accuracy, or timeliness of website content. Pricing, service scope, and project timelines are subject to individual project agreements.

5. SMS / Text Message Terms (A2P Compliance)

Indussi uses Application-to-Person (A2P) SMS messaging via 10-digit long code (10DLC) phone numbers to communicate with prospects and clients who have given express written consent. By providing your mobile phone number and consenting to SMS communications, you agree to the following terms.

5.1 How Consent Is Obtained

Indussi obtains express written consent to send SMS messages through one or more of the following methods:

  • Website forms with an explicit SMS opt-in checkbox that clearly identifies Indussi as the sender
  • Verbal or written agreement during a business call or meeting, with follow-up written confirmation
  • Response to an initial opt-in message sent by Indussi with clear disclosure of the program

At the point of consent, users are always informed of: the identity of the sender, the nature of messages to be received, message frequency, applicable rates, and opt-out instructions.

5.2 Opt-In Confirmation

Upon successfully opting in, you may receive a confirmation SMS similar to: “You’ve opted in to receive business communications from Indussi. Msg frequency varies. Msg & data rates may apply. Reply STOP to opt out, HELP for help.”

5.3 Opt-Out & STOP Handling

You may opt out of SMS communications at any time by:

  • Replying STOP, QUIT, CANCEL, END, or UNSUBSCRIBE to any message from us
  • Emailing info@indussi.com with subject “SMS Opt-Out”
  • Calling us at +1 408-569-8974

Following a valid opt-out request, you will receive a single final confirmation message and will receive no further SMS communications. You may opt back in at any time by contacting us.

5.4 HELP Response

Replying HELP to any message will return information such as: “Indussi help: call +1 408-569-8974 or email info@indussi.com. Reply STOP to opt out.”

5.5 Prohibited SMS Uses

Indussi does not use SMS messaging to:

  • Send unsolicited marketing messages to individuals who have not opted in
  • Contact individuals on the National Do Not Call (DNC) Registry without a recognized exemption
  • Send messages before 8:00 AM or after 9:00 PM in the recipient’s local time zone
  • Send deceptive, misleading, or prohibited content

5.6 Data Sharing & Third Parties

Indussi will not sell, share, or transfer mobile phone numbers or SMS opt-in data to any third party for their own marketing or commercial purposes. Phone numbers may be shared only with our messaging technology vendors (e.g., Twilio, HighLevel) strictly to facilitate message delivery on our behalf, under binding data processing agreements.

5.7 TCPA Compliance

Indussi’s SMS practices comply with the Telephone Consumer Protection

Act (TCPA), 47 U.S.C. § 227, the FCC’s implementing regulations, and the CTIA’s Messaging Principles and Best Practices. Our A2P campaigns are registered through approved 10DLC channels.

6. Email Communications

Indussi may send you service-related and marketing emails in compliance with the CAN-SPAM Act. All marketing emails will clearly identify Indussi as the sender, include a physical mailing address, and provide a clear and functional unsubscribe mechanism.

To unsubscribe from marketing emails, click the “Unsubscribe” link included in any email or contact us at info@indussi.com. Transactional emails related to active service engagements (e.g., drawing deliveries, invoices, RFI responses) are not subject to marketing opt-out controls and will continue as necessary.

7. Intellectual Property

All content on the Indussi website — including text, graphics, logos, service descriptions, project images, and code — is the property of Indussi LLC or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or publicly display any content from our website without prior written consent from Indussi.

7.1 Client Deliverables

Upon full payment of all fees for a project, Indussi grants the client a nonexclusive license to use the delivered drawings and documentation for the specific project described in the applicable service agreement. Ownership of proprietary templates, standard details, and software used in production remains with Indussi unless otherwise agreed in writing.

8. User-Submitted Content

When you submit structural drawings, project files, specifications, or other materials to Indussi for the purpose of obtaining a quote or receiving services, you represent that you have the right to share such materials. You grant Indussi a limited, non-exclusive license to use these materials solely for the purpose of providing the requested services.

Indussi treats all submitted project materials as confidential and will not share them with third parties except as necessary to deliver the services you have engaged.

9. Service Engagement & Project Terms

Specific terms governing individual project engagements — including scope of work, deliverables, timelines, revisions, and payment — are set forth in separate written service agreements or statements of work. In the event of any conflict between these Terms of Use and a project-specific agreement, the project agreement shall prevail.

Indussi reserves the right to decline any project engagement at its sole discretion.

10. Disclaimer of Warranties

Indussi expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not warrant that the website will be error-free, uninterrupted, secure, or free of viruses.

Information on our website, including service descriptions and general guidance, is for informational purposes only and does not constitute professional engineering advice. All project-specific engineering recommendations are governed by separate professional service agreements.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Indussi LLC, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or business interruption, arising from:

  • Your use of or inability to use our website
  • Any errors or omissions in website content
  • Unauthorized access to or alteration of your data
  • Any third-party conduct or content linked from our website

In no event shall Indussi’s total liability to you for any claim arising from these Terms or use of the website exceed one hundred US dollars ($100.00).

Some jurisdictions do not allow limitations on implied warranties or liability, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Indussi LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from: (a) your violation of these Terms; (b) your misuse of the website or our services; or (c) your violation of any applicable law or third-party rights.

13. Governing Law & Dispute Resolution

These Terms of Use are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or your use of our website shall first be subject to good-faith negotiation between the parties. If not resolved within 30 days, disputes shall be resolved through binding arbitration administered in Alameda County, California, in accordance with the American Arbitration Association’s Commercial Arbitration Rules.

Notwithstanding the above, either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction in Alameda County, California.

14. Modifications to Terms

Indussi reserves the right to update or modify these Terms of Use at any time. We will indicate the effective date of the most recent revision at the top of this page. Your continued use of our website following any changes constitutes acceptance of the updated Terms.
